In a marital breakdown situation we give sound sensible advice on the legal rights of parties and their legal options. Marriage breakdown is a very stressful time and we can advise on various supports to assist clients through this difficult time. The form of divorce introduced in Ireland is a peculiar form, not found in any other jurisdiction. We advise on the effect and implications of the Divorce Act, 1996 as it affects the unique circumstances of each individual client.

In many instances a client in a marriage breakdown situation will want to agree the terms of their separation. We can guide such a client through the legal process so that they achieve a legal separation by way of a legal Separation Agreement. If you think that you might be in the unfortunate situation of a marriage breakdown then contact us at an early stage to discuss your legal rights and legal options.

We have written many articles and given presentations on subjects in this area. We advocated strongly for reform of the Guardianship of Children Act, 1964. We have written a number of papers on how the state should change the entire area of guardianship, custody and access of children for the benefit of all concerned, parents, children and society as a whole. Following on from the Law Reform Commission Report and recommendations for reform of this area the government has introduced the Children and Family Relationships Act, 2015 which brings significant changes to the law in this area.

We also have significant experience of cases where the state intervenes in a family. This usually involves social workers of the Child and Family Agency (Tusla) becoming involved with children or vulnerable adults. It can involve meetings with the Child and Family Agency (Tusla) or court proceedings such as for a Care Order, Interim Care Order, Emergency Care Order, Supervision Order or an application to have a person made a ward of court.
